Overview

Our goal at XQ Message is to protect your privacy. This Privacy Policy explains how XQ Message protects personal information provided to XQ Message to use XQ Message services and how XQ Message uses that information in connection with its services. In the spirit of transparency, we want you to know what information may be collected and how it may be used. The information we collect is limited to that user data necessary for effective operation of our business and security. By using our services, you are consenting to the practices described in this Privacy Policy.

What information do we collect?

During registration or subscription, we collect certain information including: your subscriber ID (your email), your operating system version, the product being installed, payment information (if applicable), and VAT number (for EU customers). When providing services, the information we may collect include, without limitation:

  • Usage data: We don’t know anything about the messages you’re sending but we do track the number of messages sent, the exportation of keys, and whether messages are decrypted. We also identify your IP-address and the date and time of any communication. Also, if you’re using our premium features, such as authenticated access, we’ll know the number and frequency of features used by you.

  • Metadata data: When using XQ Message metadata will be created including encryption keys, expiration date/time for the encryption keys, and the use of the encryption key for decryption. If you’re using XQ Message to send attachments, we’ll know the size of the file to ensure it’s properly packed and unpacked. However, we don’t know what’s in the attachment - only you and the person you send it to will ever know that information.

The Website is not directed to and we do not knowingly collect data from individuals under the age of sixteen (16). We require that these individuals not provide data through the Website.

What do we use your information or data for?

Any of the information we collect from you may be used in one of the following ways:

  • Confirmation that XQ Message works properly and you are receiving a high quality experience 

  • Customer service assistance and response to inquiries from you regarding the services, terms and conditions or other policies that may apply to you

  • Technical support (your information helps us to effectively respond to any support needs)

  • Development of additional services through analysis of data related to browsers and mobile devices used

  • Processing of payments

  • Preventing fraudulent activity

  • Improving security

Do we use cookies?

Yes. Cookies are small files that a site or its service provider transfers to your computers hard drive through your Web browser (if you allow) that enables the site or service provider systems to recognize your browser and capture and remember certain information. If you turn off cookies, you may still access the xqmsg.com site and learn about the product, but using the XQ Message Chrome extension requires cookies in order to connect with your Gmail account.

Where do we process data?

We locate our data centers in the United States and by utilizing our services, you expressly instruct us to process personal data within the United States and consent to its processing in accordance with this privacy policy. We do not store any information created by the use of XQ Message services only on our US-based servers.

Do we disclose any information to outside parties?

We do not sell, trade, or otherwise transfer your personal information except in accordance with this policy. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. For instance, data will be used to confidentially process credit card transactions. We may also release your information when release is required to comply with the law, enforce our site policies, or protect ours or others’ rights, property, or safety. Non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses. As part of our no-spam policy, XQ Message will not sell, rent, trade, or give away your email address or other contact information to any other organization. XQ Message reserves the right to share data to third parties in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or part of our business, assets or stock.

We use sub-processors to provide us with some services that are necessary to provide the features of our website.

Third Party Collection of Data

This policy does not apply to information or data collected by a third party.

Data Retention and Data Subject Rights

If you are an EU citizen and you wish to request that we (a) identify the personal information we have about you; (b) delete the personal information we have about you; or (c) exercise any other data subject right you may have under applicable law, please email us at privacy@xqmsg.com and we will work with you to comply with your request as legally required.

California Online Privacy Protection Act Compliance

Because we value your privacy, we have taken the necessary precautions to comply with the California Online Privacy Protection Act. We therefore will not distribute, with the exceptions contained in this Privacy Policy, your personal information to outside parties without your consent.

Online Privacy Policy Only

This online Privacy Policy applies only to information collected through our website and not to information collected offline.

EU Residents

XQ Message processes personal data only on documented instructions from the controller, including with regard to transfers of personal data to a third country or an international organization, unless required to do so by Union or Member State law to which the processor is subject; in such a case, the processor shall inform the controller of that legal requirement before processing, unless that law prohibits such information on important grounds of public interest. XQ Message ensures that persons authorized to process the personal data have committed themselves to confidentiality or are under an appropriate statutory obligation of confidentiality. XQ Message complies with the General Data Protection Regulation. 

XQ Message will, at the choice of the controller, which should be exercised via the Service or by emailing the choice to privacy@xqmsg.com, delete or return all the personal data to the controller after the end of the provision of services relating to processing, and will delete existing copies unless Union or Member State law requires storage of the personal data.

Your Consent

By using our site and any software supplied by XQ Message, you consent to our Privacy Policy. If you do not consent to the collection and processing of the information required to be processed, we are unable to provide you with our service, and you should not use our site.

Changes to our Privacy Policy

If we decide to change our Privacy Policy, we will post those changes on this page, send an email notifying you of any changes, and/or update the Privacy Policy modification date below. Policy changes will apply only to information collected after the date of the change. Your continued use of services will constitute consent to any Privacy Policy change.

Security 

The driving principle of XQ Message is security of information and data. We use reasonable measures to protect your information and data. We require third party service providers to do the same as to any information or data they maintain for us. Unfortunately, these security efforts may not be infallible. If you have a privacy complaint or concern that security of your information has been compromised, please contact us directly to first attempt to resolve any issue. We work to protect the security of your personal information during transmission by using encryption protocols and software. We follow the Payment Card Industry Data Security Standard (PCI DSS) when handling credit card data.  We maintain physical, electronic, and procedural safeguards in connection with the collection, storage, and disclosure of personal customer information. Our security procedures mean that we may occasionally request proof of identity before we disclose personal information to you. It is important for you to protect against unauthorized access to your password and to your computers, devices, and applications. Be sure to sign off when finished using a shared computer.

Conditions of Use, Notices, and Revisions

If you choose to use our services, your use and any dispute over privacy is subject to this Privacy Policy and Terms & Conditions, including limitations on damages, resolution of disputes, and application of the law of the state of California. If you have any concern about privacy at our company, please contact us with a thorough description, and we will try to resolve it. Our business changes constantly, and our Privacy Policy will change also. You should check our websites frequently to see recent changes. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your account. We stand behind the promises we make, however, and will never materially change our policies and practices to make them less protective of customer information collected in the past without the consent of affected customers.
